Disclaimer for machinery inspections and valuations
The value assessment or condition assessment of used construction machinery is made to the best of the knowledge and belief of the owner or his representative. However, no liability is assumed for any hidden defects on inspected or tested machines. In particular, liability for any consequential damages resulting from hidden, concealed or unrecognizable defects is excluded. A liability of the owner is only given if he grossly negligently violates the obligations arising from an accepted order or deliberately conceals defects. The client is aware that especially in auctions only a limited possibility of testing the machines is possible. Therefore, any liability for the accuracy of the information, unless the condition is obvious, is excluded. Also excluded is any responsibility for the correctness of operating hours and ownership.
Place of jurisdiction
The place of jurisdiction is the court responsible for the company headquarters at the place of residence of the owner Wolfgang Bühn.
The law of the Federal Republic of Germany applies to these terms and conditions and the entire legal relationship between Wolfgang Bühn and the client. The application of the UN Convention on Contracts for the International Sale of Goods (CISG) is excluded.
Obligations of the client
The client is obliged to accept and pay for the services to the extent agreed upon.
Interest rate for delayed payments
Wolfgang Bühn is entitled to charge an interest rate of 8% p.a. for late payments. Any expenses for reminders in case of delayed payment are not affected by this.
